Saya baru saja melaksanakan pertemuan bilateral dengan Ibu Presiden dan Delegasi menyangkut hubungan kedua negara, Indonesia dan Swiss.

<i>Good morning Your Excellency President Micheline Calmy-Rey and members of the press. I have just recently had bilateral meeting between the delegation of Indonesia and Switzerland.</i>

Kunjungan beliau adalah kunjungan pertama sebagai Presiden Swiss dan kita mendapatkan kehormatan yang tinggi dan ini merupakan tonggak sejarah yang penting bagi kerjasama dan hubungan antara kedua negara dan kedua bangsa.

<i>The visit of the President is the very first of visit and I can speech it a milestone visit in the relations between Indonesia and Switzerland.</i>

Kami juga mengucapkan selamat atas terpilihnya beliau sebagai Presiden Konfederasi Swiss dan di bawah kepemimpinan beliau, saya yakin Swiss akan bertambah maju dan hubungan bilateral kita akan bertambah kuat.

Swiss adalah partner yang sangat penting bagi Indonesia. Dewasa ini adalah 75 perusahaan Swiss yang mempekerjakan sekitar 60.000 tenaga kerja Indonesia.

Kerjasama di bidang perdagangan baik. Selama 5 tahun terakhir naik, kurang lebih 17% dan sekarang volume perdagangan kedua negara sekitar 450 juta dolar Amerika Serikat.

Investasi juga berjalan dengan baik, kerjasama kami dengan Swiss dan peringkat Swiss sekarang menuju ke peringkat yang atas dengan total investasi lebih dari 3 miliar dolar Amerika Serikat sampai dengan tahun 2006 yang lalu.

Kami juga berterima kasih atas kerjasama yang baik di bidang Usaha Kecil dan Menengah, Small and Medium Enterprises. Ini sangat penting, agar dengan kerjasama di bidang UKM ini, UKM-UKM di Indonesia bisa tumbuh dengan baik, mendapatkan pengalaman di dalam pemasaran dan penjualan. Dengan demikian, akan lebih menggerakan lagi Usaha Kecil dan Menengah di Indonesia.

Kerjasama sama di bidang pendidikan juga kita sepakati untuk dilanjutkan. Pemerintah Swiss memberikan beasiswa kepada mahasiswa kita untuk belajar di Swiss. Kita pun juga memberikan beasiswa untuk mahasiswa Swiss untuk belajar di Indonesia, khususnya pada budaya dan Bahasa Indonesia.

Kami juga sepakat untuk melaksanakan kerjasama di bidang hukum dan hak asasi manusia, termasuk yang kita sebut <i>mutual legal assistance</i>. Dan saya sampaikan kepada Ibu Presiden, bahwa Indonesia terus melaksanakan upaya pemberantasan korupsi dan pengembangan <i>good governance</i>. Dengan demikian, kerjasama seperti ini sangat penting, karena pemberantasan korupsi, termasuk aset <i>tracking</i> dan <i>aset recovery</i>.

<i>We have also agreed to develop cooperation in the legal and mutual legal assistance field where we hope this would have in to be recovered proceed that where dirive from corruption.</i>

Kita juga membahas masalah <i>interfaith dialogue</i>, dialog antar agama, kepercayaan, peradaban dan kami berdua sepakat, baik Swiss maupun Indonesia terus berkontribusi dalam upaya untuk membangun saling pemahaman, pengertian antar berbagai komponen yang berbeda identitas.

<b>Presiden Konfiderasi Swiss</b>
<i>Ladies and Gentlemen,
First of all let me e xpress here my solidarity and symphaty on that of the Swiss Government and Swiss people after the tragic event of the floods in Jakarta. These floods off course, their lives do many people and caused many important to material damages. The Switzerland will contribute to the aid efforts and emergency that the Swiss give aid the Indonesian and international community our bringing to the population. To these effects, we have decided to give emergency aid of half millions Swiss France which is about 400.000 dollars in the food stuffs and humanitarian aid both through private sector and the Red Cross.

Mr. President,
Let me also thank you here for your invitation to Indonesia and for your hospitality. I am happy that this meeting could be organized, Switzerland then Indonesia already have close and very good relations. Indonesia is a country which is important for Switzerland. We have common interest and we have decided that we could ensure intensify our bilateral relation.

On the economic field, figured show a certain growth and yet we think it could still be back in the risk capacity for improvement. Swiss’s direct investments total right now 3.5 billions Swiss France which is approximately 3 billons dollars. Switzerland is among the first investor for investor in Indonesia, there are 75 Swiss firms which are active in Indonesia. We provide jobs for about 60.000 people in the country.

As far as trade is concerned, there is a potential of growth. In this conte xt, we have discussed the possibility of concluding an agreement, free trade agreement between Indonesia and the AFTA. I am for my part convinces that the negotiation of such an agreement would be a very important step to reinforce and broaden economic cooperation between our two countries.

Concerning framework conditions, we are signing this afternoon, an amendment to adapt taxation agreement to which we had since 1980’s, we believe that the improvement of this framework conditions will also improve trade’s steady.

We’ve talked about mutual legal assistance and in this respect, I have indicated that we have in Switzerland lost since 1981 which allows us to grow mutual legal assistance and heritage to tra ce assets and fight question of corruptions.

We have also agreed that in this particular field, we can have a better cooperation and we will cooperate much more closy in the matter of assets recovery.

Ladies and Gentlemen,
I think that Switzerland this so far the only country which has been able to proceed and to resitude such stolen assets. In the matter of the Abacha case in Nigeria, Switzerland has been able to return 750 millions dollars and in the Marcos perhaps its 500 millions dollars which had been restituded. In that is fact, we have been very active in restitution regarding political e xpose person.

Switzerland, it’s also to this steady only country which has an institute at graduate level at university which helps to work in the field of asset restitution.

On the political level, we have done the round of president international questions and in specificly the situation on the Middle East, Iran and in Kosovo, we have been able to notice that on these files we had abroad convergens of used and to find a peacefull solution and concentary solution.

This last point is particularly throws to my heart, Switzerland indeed is not a member of the European Union, we do not participate or belong to Millitary alliances. We are new free country without hidden agenda. We are, I would relation with all the countries in the world are based on economic and financial no how and a humanitarian’s tradition.

Switzerland is the cradle of the Red Cross and public policy of Geneva Convention. We are always engaged to make sure that there is a respect for minimum of humanity in international relations. In this context, we have also talked about concrete measures we could take and particuraly in the framework of the human right, Council Geneva, where we will try and find specific cooperations.

And that is exactly for that reason that we are engaging peace promotion and respective human rights also in the framework of the peace process in Aceh. And I would like here specificly to congratulate you, Mr. President and your government for the conclusion of historical agreement.

Actually, I shall in Aceh the day after tomorrow and I will be able that to inaugurate what water plant that we have developed in order to help the local population.

Selamat siang. Pertama mungkin kepada Bapak Presiden. Mungkin bisa dijelaskan tindak lanjut dari <i>mutual legal assistance</i> yang ditandatangani antara dua negara dan juga mengenai aset-aset yang mungkin yang sedang dilacak oleh Pemerintah Indonesia di sana dan juga respon dari Pemerintah Swiss?

Yang kedua ke Madame Calmy-Rey. Dalam meningkatkan hubungan investasi, apakah emang potensi mana saja atau area-area spesifik mana saja yang akan dilakukan oleh Swiss dalam tahun ini, terutama di bidang perdagangannya?

Kepada Madame Calmy-Rey, jadi untuk tahun 2007 ke depan, Pemerintah Swiss atau mungkin para investor swasta dari Swiss apakah akan meningkatkan investasi di Indonesia dan di bidang apa saja investasi itu akan ditanamkan di Indonesia?

<i>Thank you the question from the member of the press was to ask whether in 2007 the Swiss Government will increase investment in the private sector and in which domain, in particular domain.</i>

<i>Indeed the reply and reply your question, I should say that direct Swiss investment does not depend from the government, it depends from the will of the private sector. In this respect, the framework conditions, business conditions are competitiveness, are the key factors. This is why I am very happy that we have posibility this afternoon to sign this amendment to double deck session, a treaty that will safe me help in this respect. Indeed we had big increased in 2007. We are now the second investor in Indonesia that is a very good thing. But we believe and that I said before, that if we can conlude an agreement with AFTA and Indonesia then we can even more improve our conditions, framework conditions.</i>

<i>Yes, Madame President, one of the members of the Indonesian press is asking me to say more on our cooperation in mutual legal assistance including the case of asset recovery. I would like to answer in Indonesian language.</i>

Meskipun kita belum punya <i>treaty</i> dengan Pemerintah Swiss, tapi kita sepakat untuk melakukan kerjasama di bidang penegakan hukum.

<i>Yes, In reply to the question from the Indonesian member of the press, I would like to say that eventhough the Indonesian Government has not yet have a treaty with the Swiss Government but this is not preclude cooperation between our to nations.</i>

Sebagaimana yang dijelaskan oleh Ibu Presiden, apabila dalam kerjasama kita ke depan Indonesia perlu melacak aset kita yang barangkali ada di Swiss, maka dengan aset ini tentu dibawa oleh mereka yang kita duga melaksanakan korupsi, tentu dengan kerjasama ini, kita bisa lakukan langkah-langkah yang tepat untuk kembali melacak aset itu dan kemungkinan pengembalian aset tersebut.

<i>As already explained by the Excellency Madame President, we could also develop cooperation in tracing the asset that could be held in Switzerland and could be returned back to Indonesia.</i>

<i>I just want to say Madame President that inconjuction with this kind of cooperation eventhough we do not have treaty yet, but we could cooperate well in tracking the asset and the possible framework by asset recovery, If that is suspicion of any Indonesian asset to be placed in Switzerland. This’s the cornerstone of our commitment for having mutual legal assistance in this arena. </i>

<i>Our question to Mr. President, I just would like to know which is the state situation, the present situation concering the floods in Jakarta and how and where will the amount Swiss’ aid be used?</i>

<b>Presiden Republik Indonesia</b>
<i>The overall situation is improving eventhough we still e xpect that the rain will come again in Jakarta. That why what we are doing now is continuing our emergency relief operation to provide food, medical supply and other treatment to be evacuated who are now living in the temporaty shelter.

The problem we are facing is on the one hand we are facing heavy rain over and around city of Jakarta at the same time, we are also having the rise of our sea level and it is reported due increase 1.7 meters. That’s why we still e xpect the unexpected what we are doing now is to ensure that all emergency relief operation is well-implemented.

The humanitarian assistance given by the government of Switzerland, I have to be thankfull for that Madame President will be channeled to the coodinationg body for disaster management. And I do hope this also to be channeled again to the local government and to be used properly in having the evacuate specially in providing the food, medical supply.</i>

<i>Mr President just to add this, as I said our aid has been increased up to 500.000 France and it will be particulary for a lot of supply of course in the guardian and through in coordination Indonesian authority it will be in West Jakarta, in place called Rawa Badak?</i>

Terima kasih Bapak Presiden dan Ibu. Saya Fajar Ilham dari SCTV. Mohon maaf kalau ingin mempertegas lagi masalah kerjasama soal penegakan hukum, karena Jaksa Agung sudah mendapatkan surat dari Bapak untuk mengusut dan melakukan penegakan hukum terhadap aset Tommy Suharto yang mungkin berada di Swiss. Apakah itu juga dibicarakan dalam hal ini dalam pertemuan ini, karena kita melihat tampaknya ada semacam dalam tanda kutip perlawanan hukum dari pihak yang sedang diusut ini di Swiss, apakah itu juga akan di-<i>follow up</i> lebih lanjut lagi?

Kita tidak membahas kasus demi kasus pada level saya dengan Ibu Presiden. Kita membahas satu komitmen dan kesepakatan untuk kerjasama di dalam penegakan hukum. Pejabat terkait seperti Jaksa Agung dengan kewenangannya, dengan otoritas dan tugas-tugasnya tentu akan menjalankan semua kerjasama apapun, termasuk kasus yang Saudara angkat. Saya tidak bisa berbicara terlalu dalam masalah hukum karena otoritasnya ada pada Jaksa Agung dan penegak hukum yang lainnya. Tetapi semangat kami adalah kita ingin meningkatkan kerjasama di bidang penegakan hukum, termasuk <i>asset tracking and asset recovery.</i>

<i>Thank you very much in reply to your question, I would like to underline that has not been our discussion on cases per cases but rather on general substances of issues such as in the cooperation in legal field. The legal issue is covered by the relevant authorities such as the Attorney General in there which of course engage in cooperation with this Swiss Party perhaps also including the case that you mention earlier for Mr. Tommy Suharto. And so including also in cases of asset recovery. </i>

<i>On this point Mr President, as I mention earlier, Switzerland has allowed since 1981 which allows cooperation for quick and efficient legal mutual assistance, if there is a request of the authority of this country. We have indeed not discuss any specific case during the talks. We have dicussed the general framework that is what we intend to do in term of close of cooperation.</i>

<i>Mr. President and Madame President, you mentioned very well an agreement about collaboration between the Switzerland and Indonesia concering the legal system hoping to recover corruption, I want to ask you what was the specific action you’re waiting, e xpecting from the Swiss Government to have in that matter and the other hand what is the specific action your government will be able to fulfill to recover corruption in that collaboration? Thank you.</i>

<i>Yes besides our cooperation in that arena in general, with this spirit of this cooperation, I do e xpect that if any case happen that we have to cooperation with the government and authority in Switzerland for e xample again in asset tracking, asset recovery then we could cooperate effectively, we could cooperate well to find the prospectus and to be able to conduct through investigation on that matter. That’s my e xpectation and I believe very strongly with this spirit, we will move into that arena if is there any case that we have to persuade with our mutual legal assistance.</i>
